Murder Charge: Man Remanded In Prison Pending DPP's Advice

An Ebute Meta Chief Magistrates' Court on Friday ordered the remand of  a 23-year- old man in Ikoyi Prisons pending when the Lagos State Director of Public Prosecutions (DPP) will give a legal  advice on the murder charge preferred against him.

Dare Gabriel, who lives at No. 12, Ifelodun St., Igando, a Lagos suburb, was charged with using a stick to kill his friend, 35-year-old Mr Omordi Austine on Feb. 29.  

His plea was, however, not taken by Magistrate M. O. Olubi who ordered his remand.

“The accused, at about 10.30 p.m., killed Austine by hitting him with a wooden plank on his ribs, an act which led to his death,” the prosecutor, Insp. Sam Omoyeni, told the court.

The prosecutor alleged that the accused committed the alleged offence because of a clash he had with the deceased.

Omoyeni said that the offence contravened Section 221 of the Criminal Code, Laws of Lagos State, 2011.

The Magistrate adjourned the case to April 26 to enable the court to get the DPP's advice.
