Tribunal Dismisses PDP Petition Against Katsina APC Rep



The National Assembly Election Petition Tribunal in Katsina State yesterday dismissed the petition of Peoples Democratic Party (PDP) against the All Progressives Congress (APC) over Mashi/Dutsi Federal Constituency bye-election.
The tribunal chairman, Justice Raheem Shiyanbola, sitting with Justices Tijjani Yusuf Yakasai, and Haliman Saleeman, said the suit filed by PDP and its flag bearer at the 20th May, 2018, bye-election, Nazif Bello Yusuf, lacked merit and could not be proved by the petitioners.
The tribunal also held that the petitioners failed to show that the alleged imaginary figures or fictitious votes were responsible for the victory of APC candidate, Mansur Ali Mashi, at the poll.
According to the tribunal, the alleged falsification of result was not proved while the said wrong computation of both the two candidates’ result was not enough to affect the substantial compliance of the bye-election with the Electoral Act.

The petitioners, through their lead counsel, Barr. Uyi Igunma, had prayed the tribunal to declare the incumbent member of the House of Representatives from the constituency, Mansur Ali Mashi, as wrongly elected and return Nazif Bello-Yusuf as the winner of the poll.

The defence counsel led by Ernest Obunadike however urged the tribunal to disregard the submission of the petitioners.
