Court To Decide On Zamfara APC Crisis Sept 14

A federal high court sitting in Abuja has yesterday given APC Yari faction in Zamfara State Friday 14th September to appear before it and show cause why the court should not grant the request of senator Marafa faction of APC to declare it as the duly elected APC Executive in the state.

The ultimatum given to the Yari faction came as a result of suit filed before the federal high court with Suit No. FHC/GS/CS/27/2018 is between Alh. Sirajo Garba & Ors vs. APC & 7 Ors.

A press briefing by the counsel of the Marafa faction, Chief Ogwu Onoja SAN explained the reasons behind the court decision of inviting the Yari faction of APC.

The statement reads: “It came up today before the vacation court sitting in Abuja for hearing of three (3) ex-parte motions or applications.

“The first motion was for leave to sue the 2nd – 7th Defendants in a representative capacity so they shall defend the suit on behalf of other defendants too numerous to be named as defendants. The motion was granted.

“The second motion was for leave to serve the 1st and 8th Defendants by substituted means rather than personal service. This was also granted by the Honoruable Court.

“The third and final motion was praying for orders of interim injunction against the defendants from parading themselves or being recognized as Executives of APC at the Wards, Local Government Areas and State level in Zamfara State, abridgment of time to file their response and accelerated hearing of the suit.

“The Honourable Court granted the prayers for abridgment of time and accelerated hearing. However, in respect of the reliefs for interim injunction, the court held that the defendants be given Friday, 14th September, 2018 to appear in court to show cause why the order of injunction should not be made or granted.

“The matter was therefore adjourned to 14th September, 2018. “
