A Mapo Customary Court in Ibadan, Oyo State on Thursday dissolved a 16-year-old marriage between one Balikis Hassan and her husband Shehu Hassan over threat to life and battery.Balikis, an Ibadan based trader, sought for dissolution of her marriage to her estranged husband over constant battery and drunkenness.
The petitioner told the court that the respondent had the habit of beating her in any slightest provocation.“Due to incessant battery that I suffer from Hassan, I then chose to be returning home late in the night, but it did not stop him from beating me.“In fact, it was as if he married me purposely to beat me, during any slightest provocation.
“Worst still, he is in no way a responsible father to the children, let alone be a caring spouse to me because I am solely responsible for the education and welfare of the children.
“That is the reason why I am asking the court to put an end to our union,’’ Balikis said.The respondent agreed to the petitioner’s call for the dissolution of the marriage.“The separation will bring me great relief,’’ he said.
Hassan, a pepper seller, said that he beat his wife “only twice’’.“My lord, anytime I return home from the market in the evening, Balikis was never around and only returns home in the dead of the night with thick smell of alcohol oozing out of her mouth.“If I ask Balikis where she had gone to, she will say that she had gone to enjoy herself.
“Moreover, Balikis does not listen or take instructions from me anymore.“That was the reason I beat her only on two occasions,” Shehu said.Chief Ademola Odunade, the President of the court decided to grant the petitioner the request for dissolution of the marriage based on irreconcilable difference.Odunade, however, awarded custody of the two children to the respondent and told the petitioner to contact the court anytime she wanted to see her children.
