Justice Nehezena Afolabi of the Federal High Court in Gombe has adjourned hearing on a suit filed by Rambi Ayala, the Peoples Democratic Party (PDP), candidate of the Biliri East state Assembly against PDP and Rabi Daniel till November 28.
The candidate is seeking an injunction to restrain PDP from substituting his name with that of Rabi and stopping her from parading herself as the candidate of the party, having won the primary election.
The lawmaker, who was declared winner of the Gombe PDP State Assembly primary election by the party’s returning officer, also prayed the court to declare him as the duly elected candidate of the PDP for the election.
The adjournment followed the withdrawal of an application earlier filed by the plaintiff counsel, Emmanuel Adenitan, to enable the court commence hearing on the substantive suit which is to declare him winner of the primary.
“In order to dispense on all the delay, we decided to withdraw the application we earlier filed stopping PDP from substituting our client ‘s name, so that we go into the substantive matter,” Adeniran explained.
