An oil services company, Pro-Quip Nigeria Limited, has dragged the Nigerian Port Authority (NPA) before the Federal High Court in Lagos for allegedly taking over a rig sold to it by the Asset Management Corporation Of Nigeria (AMCON) illegally.
The company, in the suit numbered FHC/L/CS/693/2024, is asking the court to restrain the defendants from further trespassing on the property known as Delta Queen Goataverken Arendal AB, Sweden Friede and Goldman Gothenburg, Sweden Limassol, Republic of Cyprus with IMO No: 8756112, Others listed as first and third defendants in the suit are AMCON and Arabs & Partners Nigeria Limited.
The plaintiff stated that the motion on notice was filed under Orders 26 Rules 1 and 1 of the Federal High Court (Civil Procedure) Rules 2009 and the court’s inherent jurisdiction.
Specifically, the company is praying the court for the following reliefs against the defendants: “An order of Interlocutory injunction restraining the second and third defendants, whether by itself, agents, privies, contractors, or whosoever acting on their authority or in concert with them, from further trespassing on the property known as Delta Queen Goataverken Arendal AB, Sweden Friede and Goldman Gothenburg, Sweden Limassol, Republic of Cyprus with IMO No: 8756112, which is the subject matter of this suit pending the final determination of the substantive suit.
Italso sought an order of Interlocutory injunction restraining the second and third defendants/respondents, whether by themselves, agents, privies, contractors, or whoever acting on their authority or in concert with them, from selling, alienating or dispensing the property pending the final determination of the substantive suit.
The plaintiff is further asking the court for an order directing the second defendant to extend the 60 days which stopped the claimant’s work plan and affected the claimant to achieve its dismembering of the rig within 225 days occasioned by the omission of the second defendant.
The plaintiff in affidavit of Urgency filed in support of the motion on notice, which was deposed to by its lawyer, Victor Chinedu, stated that it is a registered company under the Corporate Affairs Commission of Nigeria, carrying out its business under the inherent Jurisdiction of the court at the material time when it purchased the rig.
The plaintiff stated that it is the owners of the property known as Delta Queens Gotaverken Arendal AB, Sweden Friede and Goldman Gothenburg, Sweden Limassol, Republic of Cyprus, with IMO No: 8756112.
Meanwhile, none of the defendants have filed any counter to the claimants’ suit.
Also, no date has been fixed for the hearing of the suit.
