Court Stops PDP From Dissolving State Exco

Justice Joyce Abdulmalik of the Federal High Court sitting in Abuja, has stopped the leadership of the Peoples Democratic Party (PDP) from dissolving the state executive Committee of the party in Cross Rivers State.

The 34 Executive Committee member  of the party I  the state led by Barrister Venatius Ikem, dragged the party, it’s Chairman, Umar Damagun and the Independent National Electoral Commission, INEC, before the court to challenge dissolution of the Congress of the party in the state.

Justice Abdulmalik, after listening to submission  by Baba Is a, Counsel to the plaintiffs ordered parties to maitain status quo

She held, “That all the concerned parties listed in this application SHALL maintain STATUS QUO in respect of the res in issue pending the hearing and determination on its MERIT of the Motion on Notice with Suit No:FHC/ABJ/CS/ 1973/2025 filed on 23rd Server, 2025.

“THAT the Plaintiffs/Applicants SHALL forthwith serve on all the Defendants/ Respondents the Motion on Notice with Suit No:FHC/ABJ/CS/ 1973/2025 filed on 23rd September 2025, along with all relevant processes filed in this matter, So as not to foist a ait accompli_on the Outcome of the reliefs sought in this application which are also exact same Teliefs prayed in the Motion on Notice With Suit No:FHC/ABJ/CS/1973/ 2025.”

The applicants had in a motion dated September 19, 2025 prayed the court to stop the party and it’s chairman from dissolving the State Executive Committec Of the 1st Respondent (PDP) in Cross River State or suspending the Plaintiffs/Applicants from their positions in the State Executive Committee of the 1st Respondent in Cross River State or in any manner tampering with or truncating the term of office of the Applicants in the State Executive Committee of the 1st Respondent in Cross River State pending the hearing and determination of the Motion on Notice filed before this Court.

They also prayed for an interim injunction restraining the 3rd Respondent  (INEC) either by themselves, their servants, agents, officers and privies howsoever called from giving effect to any purported decision of the 1st Respondents by dissolving the State Executive Committee of the Respondent in Cross River State pending the hearing and determination of the Motion on Notice filed before this Court.

 

 

The case has been adjourned to October 30 for hearing.
