Court Fines Kano Govt N10m For Violating Deposed A Right

A Federal High Court in Kano has ordered the state government to pay the 15th Emir of Kano, Alhaji Aminu Ado Bayero, N10 million compensation for the breach of his fundamental right, personal liberty and freedom of movement.

This ruling followed Governor Abba Yusuf’s directive to arrest the deposed emir.

The presiding judge, Justice Simon Amobeda, gave the order while delivering judgment in the case instituted by Aminu Bayero seeking the enforcement of his fundamental human rights.

Justice Amobeda described Governor Yusuf’s directive as unlawful, which he said had forced the applicant into house arrest and constituted a flagrant violation of his fundamental right to freedom of movement as guaranteed under Section 41(1) of the Constitution of the Federal Republic of Nigeria,1999 (as altered).

The respondents in the suit are the Attorney General of the Federation, Kano State Attorney General, Nigeria Police Force, Inspector General of Police, Kano state Commissioner of Police, DSS, NSCDC, Nigerian Army, Nigerian Air force and Nigerian Navy.

Justice Amobeda restrained the 2nd, 3rd, 4th, and 5th respondents from arresting, detaining, threatening, intimidating, harassing, or further interfering with his fundamental rights.

“The prayer for the cost of filing and prosecuting this suit is refused, the amount having not been specifically pleaded and strictly proved,” Justice Amobeda said.
