The National Industrial Court of Nigeria (NICN) has ordered the reinstatement a Chief Superintendent of Police (CSP) Adamu Damji Abare who was sacked by the Sokoto police command in 2019.
Justice R. B Haastrup of the National Industrial Court of Nigeria Sokoto division gave the order while passing judgement filed by the officer on his dismissal.
The plaintiff filed the suit against the Police Service Commission over his sack in August 2019 where he claimed that he was illegally sacked for alleged misconduct and forgery.
However, during the judgment, she declared that the termination of his appointment by an administrative panel was null and void explaining that forgery allegation is a criminal offense which should be determined by a court not administrative panel.
She added that they also punished the complainant without fair hearing.
The judge said that the defendants failed to defend their action and therefore ruled that the dismissal was unconstitutional.
She directed that the police officer should be reinstated to his rank with same salary, emoluments and all entitlements until his appointment is lawfully terminated.
