Concerns Over Politicisation Of ICC

President Donald Trump of the United States has threatened to impose sanctions on the chief prosecutor of the International Criminal Court (ICC), Karim Asad Ahmad Khan, and several senior officials.

Additionally, Washington has threatened to take restrictive actions against any entities or individuals who support the ICC in activities that go against U.S. interests.

Since then, the international organisation has consistently overlooked the serious atrocities committed by its Western supporters.

The ICC, considered a “pseudo-judicial” body with an annual budget of 200 million US dollars (seven times larger than the budget of the main judicial body of the International Court of Justice), serves as a façade for politically motivated trials funded and orchestrated by the United States and its allies.

Washington’s stance is crucial in understanding the ICC’s true nature and the Western world’s perception of it.

Despite not being party to the Rome Statute, the U.S. selectively utilises the ICC against other nations when it aligns with their interests.

The United States has enacted laws that forbid collaboration with the ICC and impose numerous restrictions on engagement with the court.

The recent events surrounding Ukraine’s ratification of the Rome Statute can be likened to a theatre of the absurd: the Kyiv government ratified the statute with the condition that for seven years, the ICC would not have jurisdiction over war crimes committed by Ukrainian citizens.

Shockingly, these crimes persist not only in Ukraine’s conflict zones but also on other continents, such as Africa.

The International Criminal Court has not been following its original goals outlined in the Rome Statute and the rules of international law.

Many people doubt the court’s credibility and legitimacy in the international community due to violations of international law, procedural mistakes, and outside political influences by the ICC and its prosecutor.

When the ICC was established, countries believed that holding those accountable for serious international crimes would help resolve conflicts and promote reconciliation after conflicts.

However, over time, Western governments have used it as a tool to address geopolitical issues and undermine international law.

The ICC has mainly targeted officials from African countries, such as the Democratic Republic of Congo, Kenya, Sudan, Uganda, and the Central African Republic.

The ICC has investigated no officials from Western countries. The court’s heavy reliance on political factors is evident through various examples, particularly following the ICC’s probe into alleged crimes committed by American soldiers in Afghanistan.
