‘KC Luxury’ Sues NDLEA Over Detention, Seeks N190m Damages

Social media influencer and businessman, Afolabi Kazeem Michael, popularly known as KC Luxury, has dragged the National Drug Law Enforcement Agency (NDLEA) before the Federal High Court in Lagos, challenging his continued detention and requesting his immediate release or bail.

Afolabi also demands N190 million in damages from the anti-narcotics agency over his unlawful arrest and detention, invasion of privacy and the circulation of his photographs and videos while in custody.

The socialite was arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport, Lagos, while preparing to travel to Paris.

The agency had linked his arrest to an investigation into the interception of 184.50 kilogrammes of cocaine believed to be connected to an international drug trafficking cartel using Nigeria as a transit route to the United Kingdom, Europe and Asia.

The NDLEA had also claimed that its investigation led to the seizure of foreign currencies and luxury items, and searches connected to the suspect.

However, in the fundamental rights enforcement suit filed before Justice Friday Ogazi on Thursday through his lawyer, Abdulakeem Labi-Lawal (SAN), the suspect is asking the court to declare his continued detention without charge unconstitutional and a breach of his fundamental right to personal liberty.

After reviewing the application, Justice Ogazi declined to grant the ex parte application but ordered the applicant to put the NDLEA on notice so it could respond to the suit.

The judge also ordered the NDLEA to produce Afolabi in court at the next hearing, that the ex parte motion, enrolled order, and other accompanying documents be served on it within four working days and to file its response within five days of service.

He then adjourned the matter to September 9, 2026, for the hearing of the substantive application.

Afolabi had claimed in his suit that NDLEA operatives arrested him on August 13, 2026, at Murtala Muhammed International Airport, Lagos, while he was preparing to travel to Paris.

In an affidavit filed in support of the suit and sworn to by his father, Eric Afolabi, the applicant claimed that the influencer had remained in NDLEA custody for 14 days without being informed of the specific offence for which he was detained or formally charged before a court.

The applicant is further seeking an order directing the NDLEA to release him immediately or admit him to bail on favourable terms pending the filing of any criminal charges.

He also alleged that NDLEA operatives searched his residence at Movamo Court, Banana Island, Lagos, after his arrest without presenting a search warrant.

The applicant claimed that the operatives searched the entire property but found nothing incriminating.
