A fresh legal battle is brewing in Delta South ahead of the 2027 general elections as a Nigerian-American family medicine physician and politician, Dr Austin Orette, has dragged the Independent National Electoral Commission (INEC) before the Federal High Court, Abuja, over his omission from the final list of candidates for the Delta South Senatorial District election.

Orette, who emerged as the winner of the African Democratic Congress (ADC) primary election for the senatorial district conducted on May 22, 2026, is challenging the omission of his name from the final list of candidates published by INEC on September 12, 2026.

The senatorial election is scheduled to hold on January 16, 2027.

The ADC and INEC are the second and first defendants respectively in the suit.

In a motion on notice filed through his counsel, James Olotu, Orette is asking the Federal High Court to direct INEC to list him as the candidate of the ADC for the Delta South Senatorial District election.

The plaintiff is relying on, among others, Sections 4 and 6(16) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), Sections 29(1) and 84 of the Electoral Act, 2026, Order 3 of the Federal High Court (Civil Procedure) Rules 2019 and Rule 4 of the Federal High Court (Pre-Election) Practice Directions, 2026.

Orette is seeking a declaration that, having emerged as the winner of the ADC primary election conducted on May 22, 2026, he automatically became the party’s candidate for the Delta South Senatorial District election scheduled for January 16, 2027.

He further wants the court to declare that INEC could not lawfully omit his name from the final list of candidates after receiving a letter from the ADC on July 14, 2026, communicating and submitting his name as the party’s candidate for the election.

The plaintiff alleged that the omission of his name from the final list published on September 12 did not comply with the provisions of the Electoral Act.

He is therefore asking the Federal High Court to declare the publication of the final list, insofar as it omitted his name as the ADC candidate for Delta South, unlawful, null and void.

Orette also wants the court to determine whether, having regard to Section 84 of the Electoral Act, 2026, his emergence as the winner of the ADC primary election on May 22 automatically made him the party’s candidate for the Delta South Senatorial District election.

Another issue he wants the court to determine is whether, having received the letter from the ADC on July 14 communicating and submitting his name as its candidate, INEC could lawfully omit his name from the final list published on September 12.

The plaintiff is also asking the court to determine whether the publication by INEC on September 12 of the final list of candidates, which omitted his name as the ADC candidate despite his emergence as the winner of the party’s primary election and the subsequent submission of his name to INEC by the ADC, was unlawful, null and void.

Orette, who is also a community advocate and describes himself as being dedicated to healing people and building a better Nigeria, is consequently asking the court to compel INEC to recognise and list him as the ADC candidate for the Delta South Senatorial District election.

The suit has now introduced a fresh legal dimension to the political contest for the Delta South Senatorial District ahead of the 2027 general elections, with the court expected to determine the legality of Orette’s exclusion from the final list of candidates.
