Abacha Sues INEC, PDP, Others Over Substitution

The son of former Head of State late General Sani Abacha, Mohammed Abacha, has taken the Independent National Electoral Commission and the Peoples Democratic Party to court over the substitution of his name as the governorship candidate of party in Kano State for the 2023 election.

Also joined in the suit are Sadiq Aminu Wali and Alhaji Shehu Wada Sagagi.

In the court document with suit number FHC/KN/CS/204 filed at a Federal High Court, Kano Division, the plaintiff, through his lawyer, Dr J.Y. Musa, SAN and Dr Reuben Atabo SAN, prayed the court to restrain Aminu Wali from parading himself as the candidate of the party for the election.

In the suit, he prayed the court for the following reliefs: A declaration that the 1st Defendant (INEC) who has in its custody the name of the Plaintiff as the winner of the 3rd Defendant’s Gubernatorial Primary Election in Kano State in the list of winners of the 3rd Defendants Primary Elections in Kano State conducted from 22nd May, 2022 to 25th May, 2022 whereof it issued Certified True Copies acted in gross violation of the provisions of Sections 32, 33 and 84(1) & (5)(b) (i) & (ii) of the Electoral Act, 2022 in recognizing and publishing the name of the 2nd Defendant (Wali) on the 22nd July, 2022 as the 3rd Defendant’s (PDP) Governorship candidate for Kano State when the Plaintiff who won the Kano State Gubernatorial Primary Election of the 3rd Defendant is not dead and has not withdrawn his candidature, among others.
