Adamawa Guber: Court Dismisses Binani’s Suit Against INEC

Justice Inyang Ekwo of the Federal High Court sitting in Abuja, has dismissed the suit filed by Senator Aisha Dahiru Ahmed Binani, the 2023 governorship candidate of the All Progressives Congress (APC) in Adamawa State.

Senator Binani had approached the court to seek judicial review of the decision of the Independent National Electoral Commission (INEC) to reverse her declaration as winner of the governorship election as declared by the state’s Resident Electoral Commissioner (REC), Hudu Yunusa-Ari.

During proceedings on Wednesday, Counsel to Senator Binani told the Court that he had already filed a notice of discontinuance as directed by the plaintiff.

He, therefore, prayed the court to strike out the suit.

However, in his ruling, the presiding judge of the Court, Justice Inyang Ekwo elected to dismiss the suit and accordingly dismissed it.

Court Declines To Hear Binani’s Ex-parte Application On Adamawa Guber

Recall that last week, Justice Ekwo refused to entertain the ex-parte application brought before it by the governorship candidate of the APC in the Adamawa governorship election.

The ex-parte application filed by her lawyer, Mohammed Sheriff, asked the court to determine whether INEC can take any further steps on the declared governorship election result made by the INEC REC.

However, when the ex-parte was about to be moved, Justice Ekwo cut in and asked Binani’s lawyer to first address him, if his court had jurisdiction to entertain such matter.

The Judge subsequently gave Binani’s counsel to file his address on the issue and fixed April 26 for hearing of the ex-parte application and the motion on whether the court has jurisdiction on the matter.
