Alleged Fraud: Court Orders Ganduje, Others To Be Served On Notice

Kano State High Court has fixed April 29, 2024 for hearing on whether respondents in the case between the state government and former Governor Abdullahi Ganduje, now All Progressives Congress (APC) chairman and five others can be served by substituted means.

In the case, which was presided over by Justice Usman Na’abba in Kano, the prosecuting counsel, Ya’u Adamu, has sought the court order to allow the respondents to be served through substituted means.
He argued that they have the legal backing to serve the respondents through substituted means.

The counsel told the court yesterday that they made efforts to serve the respondents notice on motion but could not reach them. However, the counsel to the sixth respondent was served the notice and not his client. Hence, they sought the court nod to serve them by substituted means.

The counsel to the sixth respondent (Lamash Properties), Nuraini Jimoh, argued that the law insists that in a criminal case, the respondent must be served a summon in person.

He said that even his client has not been served personally and argued that all the respondents need to be served personally as the case is a criminal case.

Consequently, Justice Na’abba adjourned the case to April 29 for hearing and directed that the six respondents be served on notice personally.
The Kano State government sued Ganduje before the state High Court on cases bordering on corruption.
