Canada Work Permit: What You Need To Know, According To IRCC

The Canadian government has reminded foreign nationals that a visitor visa or electronic travel authorisation (eTA) does not, by itself, grant them permission to work in the country.

The government said most foreign nationals seeking employment in Canada must obtain a valid work permit and meet the relevant eligibility requirements before starting work.

 

“Having an electronic travel authorisation or visitor visa does not give you the right to work in Canada,” the government stated in guidance shared by Immigration, Refugees and Citizenship Canada (IRCC) on its X handle on Thursday.

 

The clarification is aimed at dispelling the misconception that permission to enter Canada as a visitor automatically allows a foreign national to take up employment.

 

According to IRCC, a visitor visa or eTA allows eligible travellers to seek entry into Canada for temporary visits, but does not constitute work authorisation.

 

Foreign nationals intending to work are therefore required to determine whether they need a work permit and confirm their eligibility before accepting employment.

 

Canada offers different categories of work permits, principally employer-specific and open work permits.

 

An employer-specific work permit generally requires a job offer and limits the holder to the employer, location and type of work specified in the permit.

 

An open work permit, where an applicant qualifies, does not generally require a specific job offer and may allow the holder to work for eligible employers.

 

IRCC advises prospective workers to establish which category applies to them before submitting an application.

 

How To Apply For A Work Permit

 

Foreign nationals can apply for a Canadian work permit through different channels, depending on their individual circumstances.

 

IRCC allows eligible applicants to apply from outside Canada, from within the country or at a port of entry. However, the eligibility requirements differ for each option.

 

Applicants can begin the process by signing into their IRCC account and reviewing the requirements applicable to their circumstances.

 

They can also use the Canadian government’s immigration website to check processing times and track the status of their applications.

 

For job seekers, Canada’s Job Bank provides information on employment opportunities, including positions open to foreign candidates.

Under an employer-specific work permit, a job offer is generally required, while the permit specifies the employer and may also state the location and type of work permitted.

 

For an open work permit, a job offer is generally not required, but applicants must belong to a category eligible for the permit.

 

IRCC also has specific provisions for certain groups of workers, including international graduates, students, participants in International Experience Canada programmes and some family members of foreign workers.

 

Some foreign nationals may qualify for exemptions that allow them to work without a permit under specific circumstances. However, applicants are advised to confirm whether an exemption applies to them before starting employment.

 

Those who receive work authorisation may also need to meet additional requirements, including obtaining a Social Insurance Number (SIN), understanding workplace rights and labour standards, and complying with the conditions attached to their permits.

 

Foreign workers who experience workplace abuse can also access government procedures for reporting abusive employers.

 

IRCC further provides guidance on extending work permits, changing jobs or employers where permitted, restoring legal status and exploring pathways that may eventually lead to permanent residence.

 

The Canadian government warned that working without the required authorisation could have serious immigration consequences.

 

It, therefore, urged foreign nationals not to rely on a visitor visa or eTA as permission to work and encouraged prospective workers to use official Canadian immigration channels to determine their eligibility and apply for the appropriate work authorisation.

 

The distinction, according to the government, is straightforward: a Canadian visitor visa or eTA permits eligible travellers to enter the country as visitors, but does not, on its own, authorise them to work.

 

Those seeking employment in Canada should establish which work-permit category applies to them and complete the appropriate IRCC process before commencing work.
