An Abuja High Court has nullified the expulsion of the member representing Ideato North/South Federal Constituency of Imo State in the House of Representatives, Hon. Ikenga Imo Ugochinyere, from the Peoples Democratic Party (PDP).
The court declared the expulsion as an illegal action.
Recall his purported suspension was announced by a faction of the party loyal to Senator Samuel Anyanwu in Imo State.
But, the court presided by Justice N. Iheme, in its judgement, nullified the expulsion on the ground that the action was baseless and illegal.
The judge held that the 1st Defendant, Ikenga Imo Ugochinyere, was still a member of the PDP and a member of the National Assembly under the PDP constitution, saying only the National Executive Committee (NEC) of the party can discipline a serving National Assembly member
The court noted that in this instant case, the PDP NEC denied suspending or expelling the defendant.
The judgment also stated that even the PDP in its affidavit in support said that the party did not expel the 1st Defendant and only the NEC has the power to hear any allegation or set up a disciplinary committee against a sitting member of the National Assembly as provided for by its Constitution.
