Court Nullifies Expulsion Of Ugochinyere From PDP

An Abuja High Court has nullified the expulsion of the member representing Ideato North South Federal Constituency in the House of Representatives, Hon. Ikenga Imo Ugochinyere, from the Peoples Democratic Party (PDP).

The court declared the expulsion an illegal action.

A faction of the party loyal to Samuel Anyanwu announced his suspension.

However, in its judgement delivered by Justice Iheme, the court nullified the expulsion because the action was baseless and illegal.

The Judge held that the first Defendant, Ikenga Imo Ugochinyere, is still a member of the PDP and the National Assembly. The PDP constitution says that only the National Executive Committee can discipline a serving National Assembly member. In this instant case, the PDP NEC denied suspending or expelling the defendant.

The judgment also states that even the PDP, in their affidavit in support, said that the party did not expel the 1st Defendant and that only the NEC has the power to hear any allegation or set up a disciplinary committee against a sitting member of the National Assembly as provided for by its Constitution.
