An Enugu State High Court sitting in Enugu has granted an order in a motion on notice filed by Nwabueze Ugwu seeking to declare the office of the National Secretary of the Peoples Democratic Party (PDP) vacant.
The court issued an interim order in Enugu, compelling the defendants in the suit, PDP national chairman, national secretary, deputy national chairman South-East to recognise Sunday Udeh-Okoye as candidate recommended by South East Zonal Executive Committee to replace the former national secretary pending the determination of the motion on notice.
The trial Judge, Justice C.O, Ajah, said the motion on notice sought by the plaintiff, was brought under Order 38 Rule 1, Order 39 Rule 1 of the High Court Rules of Enugu State 2020, supported by 23 paragraphs affidavits deposed to by the applicant.
The court however adjourned the hearing to October 30, 2023, for the continuation of the motion on notice.
The PDP Southeast Zone had last weekend unanimously nominated the former PDP national youth leader, Hon. Sunday Udeh-Okoye, as the new national secretary.
The party’s national vice chairman, South East Zone, Chief Ali Odefa, had said the decision was to allow Senator Anyanwu concentrate on his electioneering campaign in Imo State.
“The position of the National Secretary will be a kind of distraction to his electioneering campaign and victory at the polls.
“Therefore, the South-East Zone, having met and brainstormed, we have come up with a nomination from Enugu State in the person of Rt. Hon. S.K. Udeh-Okoye to replace Senator Samuel Anyanwu as the national secretary of the Peoples Democratic Party.
“We shall send our resolutions in writing to the National Working Committee of our great party for ratification on behalf of the National Executive Committee as provided by our party constitution,” he submitted.
