A Bauchi State High Court has restrained the suspended state chairman of the All Progressives Congress (APC), Babayo Aliyu Misau, from parading himself as a member and chairman of the party in the state.
In a suit number: BA/73/2023 filed by Alhaji Al-Mustapha Zubairu at the Bauchi State High Court, the suspended chairman was restrained from parading himself either as the state chairman of the party or as a member of the APC pending the determination of the motion on notice.
The presiding judge, Justice Lamido Umar, granted the prayers of the plaintiff, Al-Mustapha Zubairu against the 1st and 2nd defendants, Babayo Misau and the APC respectively.
The judge said that upon hearing the motion ex-parte, the affidavit in support and applicant’s written address dated the 3rd day of April, 2023, praying for an order of interim injunction. And upon consideration of the said application and the exhibits in support, and having gone through the affidavit in support deposed to by Abdulhamid Attahir and the written address of the applicant adopted by his counsel, S. G. Idrees, “It is hereby ordered as follows:
“That an order of Interim Injunction be and is hereby made restraining the 1st defendant/respondent (Babayo Misau) from further parading himself as a member of the 2nd defendant/respondent (APC) or the chairman of the 2nd defendant/respondent, pending the determination of the motion on notice.
“That an order of interim injunction be and is hereby made restraining the 2nd Defendant/Respondent from dealing with the 1″ Defendant/Respondent as a Member or the Chairman of the 2nd Defendant/Respondent, pending the determination of the Motion on Notice.”
The opposition APC in Bauchi State has recently been embroiled in an internal crisis since the defeat of the party in the governorship and national and state assemblies’ elections.
APC executives of Kukadu/Gundari Ward in Misau local government of the state had during a press briefing at the NUJ Secretariat on Tuesday, removed Babayo Misau from office as the state chairman and expelled him from the party for alleged anti-party activities.
The APC Misau ward secretary, Aliyu Adamu who led other executives to take the action told journalists that they took the decision in order to save the party and instill discipline among members of the party in Misau local government area and the state in general.
According to him, the decision to expel the chairman followed a series of meetings by the party in Misau LGA where it was agreed that the action should be taken, expressing dismay that the action of the party chairman cost the APC vital votes during elections particularly the governorship election.
Adamu further alleged that Babayo did not vote for the gubernatorial candidate of the APC pointing out therefore, that the ward executives found it necessary to expel the state chairman in order to give the party a lifeline in its rebuilding process.
Babayo Misau however dismissed the expulsion, saying it did not follow the party’s constitutional guidelines, and vowed to challenge it in court, insisting that he is still the state party chairman.
