Australian designer Katie Perry has won a long-running trademark battle against American pop star Katy Perry, securing the right to continue selling clothing under her own name.
The dispute, which lasted several years, centred on whether the designer’s fashion label “Katie Perry” infringed on the singer’s global brand.
Katie Perry had argued that she registered and used the name for her clothing business before the American singer became widely known internationally. She accused the pop star of attempting to block her from using her own name for commercial purposes.
However, lawyers for the singer maintained that her music career had already gained global attention around 2008, the same period the Australian designer began selling clothes under the name.
An Australian court initially ruled in 2024 that the designer’s trademark should be cancelled, siding with the singer.
But Australia’s High Court overturned that decision on appeal, ruling that there was little likelihood the public would confuse the designer’s clothing label with the internationally known musician.
Following the ruling, a representative for Katy Perry said the singer had never attempted to shut down the Australian designer’s business despite the legal dispute.
The decision brings an end to the years-long legal battle between the two women over the use of the name “Katie Perry” in the fashion industry.
