Lindsay Clancy has appeared in court for the first time since her murder trial ended in a mistrial, as her defence seeks to prevent a retrial and have the case resolved in her favour.
Clancy, 36, appeared before Plymouth Superior Court Judge William Sullivan on Tuesday, September 29. When the judge greeted her, she responded, “Good morning.”
She is charged with first-degree murder in the January 2023 deaths of her three children, Cora, 5, Dawson, 3, and Callan, 8 months. Her defence previously acknowledged that she killed the children but argued that she was not criminally responsible because she was experiencing postpartum psychosis.
Defence Takes New Position
The five-week trial ended in a mistrial on September 4 after the jury failed to reach a unanimous verdict. Eleven jurors were reportedly prepared to find Clancy not guilty by reason of lack of criminal responsibility, while one juror disagreed.
At Tuesday’s hearing, defence lawyer Kevin Reddington took a different position, arguing that prosecutors had not presented sufficient evidence to establish that Clancy killed her children.
The defence has also asked the judge to prevent a second trial, citing double jeopardy protections and concerns about the conduct of the lone holdout juror.
Prosecutors have not yet decided whether to retry Clancy or pursue another legal option.
Judge Sullivan took the defence’s arguments under consideration and scheduled another hearing for November 2, when the court is expected to address outstanding motions and potentially discuss a retrial date.
Clancy remains in a state psychiatric facility under supervision.
