Sharia Court Dissolves Ganduje Daughter’s Marriage

Kano State Upper Shari’a Court has dissolved the marriage between Asiya Abdullahi Umar Ganduje  and her husband Inuwa Uba  through Islamic means Khul,I.

Asiya through her counsel, Barrister Ibrahim Aliyu Nasarawa, approached the court seeking the dissolution of their marriage, stating that she is fed up.

She declared her readiness to return the sum of N50,000 bride price to her husband.

In his response to the claim of the plaintiff, counsel to the respondent, Umar I. Umar, said the claims of the plaintiff were beyond the bride price. Umar said Asiya was in possession of some properties belonging to his client.

Earlier in his response on point of law, Asiya’s counsel told the court that the plaintiff would not relinquish her rights for divorce. He submitted that the plaintiff filed her claim for divorce alone.

Delivering the judgement, the judge, Mallam Abdullahi Haliru, said the evidence adduced during the trial proved that the plaintiff received the sum of N50,000.

He said the court gave the judgement based on what is the basis of the marriage which is the bride price. The judge ordered Asiya to return the N50,000 bride price and dissolved the marriage.

Addressing the court after the judgement, Umar prayed the court to supply him with records of the proceeding, indicating his interest to go to the Upper Sharia Court on appeal.
