Take Complaints To State Regulators, NERC Directs Electricity Consumers

…As 15 sub-nationals assume control

Nigeria’s electricity consumers in 15 states must now lodge their complaints with state regulators rather than the Nigerian Electricity Regulatory Commission (NERC), the agency has directed, following the transfer of regulatory powers to these states.

NERC announced the shift in a post on its official X handle, confirming that 15 sub-national governments—including Enugu, Ekiti, Ondo, Imo, Oyo, Edo, Kogi, Lagos, Ogun, Niger, Plateau, Abia Nasarawa and Bayelsa—have fully assumed control over their electricity markets under the Electricity Act 2023.

This decentralisation allows these states to establish independent regulatory bodies, known as State Electricity Regulatory Commissions, to oversee local distribution companies (DisCos) and handle consumer grievances.

“With the activation of state-level regulators in these 15 jurisdictions, all consumer complaints, tariff issues, and service quality disputes should be channeled directly to the respective state commissions,” NERC stated.

The commission emphasised that it retains oversight for the remaining 21 states and the Federal Capital Territory, where national DisCos continue to operate under its purview.

The move stems from amendments to the Electricity Act, signed into law in 2023, which empowers states to regulate and license electricity generation, transmission, and distribution within their territories.

Proponents argue it fosters competition and tailored solutions, while critics, including consumer groups, warn of potential inconsistencies in service standards across regions.

As of April 2026, the 15 states represent an estimated 60 per cent of Nigeria’s urban electricity demand. NERC urged consumers in affected areas to visit state regulator websites or offices for updated complaint procedures, promising a smooth transition to minimise disruptions.
