Appeal Court Upholds Wunyinka’s Victory At High Court Over Land Dispute

The Court of Appeal sitting at Makurdi Judicial Division in Benue State under Justice M. A. Danjuma, Justice M. S. Hassan and Justice A. Waziri has upheld the victory of Rev. Asowo Wunyika and Wonye Wunyika at the High Court of Nasarawa State in a judgment delivered by Justice Rose Soji on April 27, 2018 against Mr. Sabo Busa and 21 others over 35.29 hectares of land in Nasarawa State.

LEADERSHIP had reported that Wunyika had sued Mr. Sabo Busa and 21 others over the land at Rafin-Kwara village, Kurape District, Karu LGA in Nasarawa State which Wunyinka said originally belonged to their family, but was kept in the care of Mr. Busa for some time, but he later refused to return the said plots to the Wunyinka family.

The Nasarawa State High Court under Justice Rose Soji after listening to the facts presented before her by the Wunyinka family, gave the judgment in their favour on April 27, 2018.

However, Mr. Busa and 21 others who were not satisfied with the judgment, decided to appeal the judgment at the Appeal Court in Makurdi, where they also lost the case.

Speaking to journalists on the Appeal Court judgment, a counsel to the Wunyinka family, Olusola Egbeyinka Esq, explained that Mr. Sabo Busa and 21 others went on appeal against the judgment that was delivered by the High Court on April 27, 2018.

“By traditional history, the land belonged to the Wuyinka family, so we were able to establish that before the trial court, that is the High Court of Nasarawa state. We were able to establish that they had settled on that land and they were the ones that came upon the land against any adverse interest,” he said.

The first son of  Rev. Asowo Wunyika, Mr. Gayus Asowo Wunyika, while speaking to journalists expressed gratitude to God for the judgment, saying the judiciary had proven that they are the last hope of the common man.
