10 Things UK’s New 10-Year Permanent Settlement Rule Means For Nigerian Migrants

The British government has announced sweeping revisions to its Earned Settlement framework, doubling the standard wait time for Indefinite Leave to Remain (ILR) from five to 10 years for most foreign workers.

The updated policy links settlement eligibility to income levels, specific professions, and compliance records, impacting thousands of Nigerian migrants living and working across the United Kingdom.

The revised settlement conditions will apply retroactively to current visa holders once the Home Office officially enacts the new immigration statements of changes.

Meanwhile, migrants who breach immigration rules or enter through undocumented routes face extended settlement wait times of 20 to 30 years.

Here are 10 key takeaways explaining how the new immigration policy affects Nigerian professionals and their families:

1. Standard Settlement Wait Time Doubles To 10 Years

For the majority of Skilled Worker visa holders, the timeline to secure Indefinite Leave to Remain (ILR) has officially doubled from five to 10 years. Nigerian professionals on standard work routes must now maintain continuous visa sponsorship for a decade before obtaining permanent status.

2. High Earners (£50k+) Retain 5-Year Pathway

Migrants earning an annual salary of £50,271 or higher remain eligible for the accelerated five-year route to permanent residency. The threshold aims to reward high-earning professionals and key technical talent in competitive sectors.

3. Sub-£50k Earners Shift To 10-Year Track

Skilled workers earning below the £50,271 annual threshold will automatically move to the 10-year settlement pathway. To qualify after a decade, applicants must demonstrate sustained earnings above basic tax thresholds across their qualifying years.

4. Ultra-High Earners and Global Talent Qualify in 3 Years

Migrants earning an annual salary of £125,141 or more, along with Global Talent visa holders, retain a fast-tracked three-year pathway to ILR. This tier is designed to attract international executive leadership and top-tier innovators.

5. Pre-2025 Care Workers Keep 5-Year Option

Care workers who entered or switched into the Health and Care visa route prior to May 2025 retain their five-year pathway to settlement, provided they earn at least £25,000 annually and meet sponsorship conditions.

6. Post-2025 Care Workers Move To 10-Year Schedule

Care workers who joined the UK health sector after the May 2025 policy cut-off date will no longer qualify for the five-year route. Instead, they will follow the standard 10-year settlement timeline.

7. Public Sector Health And Education Staff Exempted

Essential public service professionals, including NHS doctors, nurses, teachers, and qualified social workers paid on national pay scales, retain a direct five-year settlement route regardless of the wider policy changes.

8. Family And Spouse Visas Unaffected

The new rules apply strictly to economic work routes. Spouses, civil partners, and parents of British citizens or settled residents will continue to follow the existing five-year family settlement pathway.

9. Student And Graduate Visa Years Excluded

Time spent in the UK on Student and Graduate (PSW) visas will no longer count toward long-residence settlement accumulation. Only continuous time spent on qualifying settlement-track visas will contribute toward the 10-year total.

10. Retroactive Implementation For Current Visa Holders

The revised settlement conditions will apply to migrants currently living in the UK once implementing statements are finalized into law. Current visa holders approaching settlement are advised to review their earnings and visa history to verify their qualifying timeline.
