DSS-SERAP: CSOs Seek Transparency, Voice Concerns Over Civic Freedoms

A coalition of over 50 civil society organisations has expressed worry about the recent defamation judgment obtained by two officials of the Department of State Services (DSS) against Socio-Economic Rights and Accountability Project (SERAP).

They also warned that the judgment could threaten civic freedoms, judicial transparency, and democratic accountability in Nigeria.

In a joint statement dated 11th May, 2026, the groups said they were troubled by widespread public reactions to the judgment, despite reports that neither the Certified True Copy (CTC) nor the full judgment had been released publicly at that time.

The civic society organisations further stated that the situation raises questions about procedural fairness, institutional responsibility, and adherence to due process.

They also argued that timely access to court judgments is essential for transparency and for allowing affected parties to exercise their right of appeal.

The coalition referenced Section 36(1) of the 1999 Constitution, which guarantees the right to a fair hearing, noting that this protection extends beyond courtroom proceedings to include access to judicial decisions and opportunities for appellate review.

They also cited Section 39(1) of the Constitution, which guarantees freedom of expression, and Section 22, which assigns the media and civic actors the role of holding government to account.

Furthermore, they referenced Article 19 of the Universal Declaration of Human Rights and Article 9 of the African Charter on Human and Peoples’ Rights, both of which protect freedom of expression and access to information.

According to the coalition, delays in releasing judgments or Certified True Copies in public-interest cases could erode public confidence in the judiciary and undermine trust in democratic institutions.

The organisations cautioned against what they termed the increasing use of defamation suits and other legal actions to intimidate civil society groups involved in anti-corruption efforts and public accountability campaigns.

They emphasised that democratic societies rely on citizens and civic organisations being able to question authority and advocate for public interests without fear of retaliation.

The coalition also rejected the notion that seeking appellate review of a court judgment constitutes contempt of court, asserting that the constitutional right of appeal is a core component of Nigeria’s justice system.

They called for the immediate release of the Certified True Copy of the judgment to promote transparency and facilitate informed legal responses.

The groups further urged respect for constitutional and international human rights protections, including fair hearings, freedom of expression, and access to justice.

They appealed to public officials to exercise restraint when commenting on judicial matters where court records are not yet available to the public.
