Firm Sues MTN, Airtel, Glo, MultiChoice For N50bn

KaaTruths Podcast Ltd and Ophoke Armstrong Amobi, otherwise known as KAA, have instituted a suit against MTN Nigeria Communications Plc, Globacom Limited, Airtel Networks Limited and MultiChoice Nigeria Limited at the Federal High Court in Abuja over issues relating to consumer rights, seeking N50 billion in general and special damages.

The Federal Competition and Consumer Protection Commission (FCCPC) is also listed as a defendant in the suit, which is marked FHC/ABJ/CV/886/2026.

According to the plaintiffs, the case raises questions about the expiration of unused data bundles and aspects of subscription services, including situations in which consumers may be unable to fully use the services within the period for which they have paid.

The plaintiffs asked the court to determine whether terms allowing unused data to expire after a stipulated validity period are fair and reasonable under applicable consumer protection laws.

They also want the court to consider whether consumers should lose the value of subscriptions where, according to their case, services were unavailable or could not be fully utilised during the period for which payment was made.

The plaintiffs cited an incident involving a N30,000 MTN data subscription purchased for 30 days.

According to the plaintiffs, the router supplied for accessing the service developed a fault, after which they requested cancellation, a refund or rollover of the unused subscription.

They alleged that the request was not granted and that the subscription subsequently expired.

The plaintiffs also referred to another case involving a 75GB data subscription, which they said was exhausted in less than seven days amid intermittent network disruptions.

They alleged that MTN did not provide details explaining how the 75GB data was exhausted within the period.

The suit also raises questions concerning Multi Choice Nigeria Limited’s subscription arrangements, including periods when subscribers may be unable to use the service or when service interruptions occur.

The plaintiffs are asking the court to make various declarations and orders concerning the practices challenged in the suit.

They are also seeking N50 billion in general and special damages.

The plaintiffs said the case raises broader questions about the relationship between consumers and providers of telecommunications and subscription services.

The court is yet to determine the claims contained in the suit. The defendants are entitled to respond and present their respective positions before the court.
