Germany has introduced an accelerated pathway to permanent residency for foreign nationals who complete university studies or vocational training in the country and subsequently secure qualified employment.

Under the revised guidance, eligible international graduates may obtain a settlement permit after two years of skilled employment, rather than waiting for the longer period that generally applies to other foreign workers.

The provision is contained in Section 18c of Germany’s Residence Act (AufenthG) and is outlined on the federal government’s official Make it in Germany portal.

The policy is aimed at encouraging skilled foreign graduates to remain in Germany and contribute to the country’s workforce, particularly as several sectors continue to experience labour shortages.

Under the general rules, skilled foreign workers may have to spend up to five years in Germany before becoming eligible for permanent residency.

However, graduates who obtained their university degree or vocational qualification in Germany can benefit from the special provision if they subsequently move into authorised skilled employment.

According to the government guidance, the accelerated route applies to foreign nationals who completed their university studies or vocational training in Germany and hold a temporary residence permit for skilled employment.

“The measures are designed to help skilled workers who have established their lives in the country move from temporary status to permanent residence,” the German government stated.

Conditions For 2-Year Permanent Residency

Foreign graduates seeking the accelerated settlement permit must meet a number of requirements.

One of the conditions is that applicants must have held a residence permit for skilled employment under Sections 18a, 18b, 18d or 18g of the Residence Act for at least two years.

Applicants must also be employed in a position covered by their existing residence permit.

Another requirement relates to pension contributions. Applicants must have paid into Germany’s statutory pension insurance scheme for at least 24 months.

Language Proficiency Is Also Mandatory.

Applicants are expected to demonstrate German language skills at the B1 level under the Common European Framework of Reference for Languages (CEFR).

They must also show a basic understanding of Germany’s legal and social system, generally demonstrated by passing the “Living in Germany” test.

In addition, applicants must demonstrate that they have sufficient living space for themselves and members of their household.

A processing fee is payable when an application is submitted, although the amount varies according to the applicant’s particular status.

Greater Freedom For Foreign Workers

The settlement permit provides greater long-term security for foreign nationals by removing the need to repeatedly renew temporary residence permits.

According to the official guidance, “A settlement permit allows foreign nationals to remain in Germany indefinitely.”

Permanent residents also gain greater flexibility in the labour market.

The status “gives holders greater flexibility in the labour market, including the freedom to change jobs or become self-employed.”

The rules also provide greater flexibility for family members seeking to join foreign workers who have obtained permanent residency.

Under the settlement status, “family members may also join them without some of the restrictions linked to temporary residence permits.”

The move comes as Germany seeks to attract and retain skilled workers in areas facing labour shortages, including healthcare, engineering, technology, education, medical technology and hospitality.

By creating a faster route from student or trainee status to permanent residency, the German government is seeking to encourage qualified international graduates to build their careers and lives in the country.
