Justice Akintayo Aluko of the Federal High Court in Lagos has restrained the Independent Corrupt Practices and Other Related Offences Commission (ICPC) from arresting or detaining Professor Abayomi Fasina, the Vice Chancellor of the Federal University, Oye, Ekiti State.

Justice Aluko issued the interim order following a suit filed by Professor Fasina in response to an ICPC’s invitation over allegations of sexual harassment made against him by a married subordinate in the university, Folashade Adebayo.

Mr Fasina was alleged to have pressured and harassed Adebayo, the Deputy Director at the university’s Directorate of Works and Services.

The court’s restraining order will remain in effect pending the hearing and final determination of Professor Fasina’s Motion on Notice for Interlocutory Injunction.

The judge also ordered the ICPC to refrain from taking any further actions related to this matter until the hearing and judgment on Professor Fasina’s application.

Justice Aluko granted the order after considering the submission from the applicant’s lawyer, Ebun-Olu Adegboruwa (SAN), in case number FHC/L/CS/768/2025.

Adegboruwa had argued that the motion is supported by an affidavit sworn by Dr. Adedayo Sobowale, a staff member at the Federal University, Oye-Ekiti, along with various documentary exhibits.
After listening to Adegboruwa’s submission, Justice Aluko held, “The court has considered the application and finds it deserving of the reliefs sought.”

The judge granted the interim order, which directs the ICPC, including its agents and representatives, to maintain the status quo concerning the applicant’s invitation and the threat to his liberty until the hearing of the Motion on Notice.

The court also issued an order preventing the ICPC from taking any further steps related to the subject matter of this fundamental rights action until the applicant’s Motion on Notice is heard and determined.

Furthermore, the applicant has been directed to enter into a formal undertaking.

The case has been adjourned to April 25, 2025, for the hearing of the Motion on Notice.
