US Court Denies Bail To Nigerian Basketball Player Over Alleged First by Degree Rape

A United States District Court in Calhoun County, Alabama, has denied bail to 21-year-old Nigerian-born student and athlete Daniel Adegboyega, following his arrest on charges of first-degree rape by forcible compulsion.

 

District Judge Randy J. Moeller ordered that the suspect remain in custody at the Calhoun County Jail as legal proceedings continue, agreeing with state prosecutors that no set of release conditions would guarantee public safety or ensure his appearance in court.

 

“The State, by clear and convincing evidence, has proven that no condition or combination of conditions of release will reasonably ensure the Defendant’s appearance in court or protect the safety of the community,” Judge Moeller ruled.

 

According to court documents and testimony presented by Jacksonville Police Department Investigator Andrew Swain, the alleged assault occurred on the night of July 28 after the victim visited Adegboyega’s residence.

 

Investigators disclosed that the victim sent distress text messages to her roommate during the encounter. After failed attempts to establish contact, the roommate alerted officers, who conducted a welfare check at approximately 2:00 a.m. and found the victim visibly distressed.

 

Police officers collected forensic evidence at the scene, including blood-stained clothing and a completed rape kit, while additional digital evidence and laboratory analysis remain pending.

Although Adegboyega admitted to the sexual encounter while denying the use of physical force, he was taken into custody on July 29 and remains held without option of bond pending trial.
