Court Grants Interim Injunction In Lekki Land Dispute

Justice Babatunde Kalaro of the Lagos State High Court in Ikeja has ordered the parties in a dispute over a property in the Lekki area of the state to maintain the status quo ante bellum pending the hearing of the suit.

Justice Kalaro gave the order after entertaining an ex parte application filed by Advance Lincon Limited against the Lagos State government and three other defendants over the ownership and control of the land allegedly linked to a company owned by the minister of Education, Dr Olatunji Alausa.

Other defendants, including the case marked LD/5991LM/2026, are the Attorney General of Lagos State, the Land Use and Allocation Committee under the Lagos State Ministry of Lands, and Lincoln Advanced Radiology Service Limited.

The judge specifically directed parties to comply with the pre-action protocol and to maintain the status quo ante bellum on the property.

The court also ordered the plaintiff to serve the motion on notice and the court’s enrolled order on all defendants within seven days.

The claimant seeks relief concerning the parcel of land measuring approximately 3,913.359 square metres situated at Lekki Peninsula Scheme II, Lagos State.

The land is subject to a Certificate of Occupancy dated 11 April 2014 and registered at the Lagos State Lands Registry.

The plaintiff had urged the court for an interim order restraining the Respondents either by themselves, their agents servants, privies, representatives or anybody acting on their behalf from invading, leasing, selling auctioning, disposing the land pending the compliance and expiration of the Pre-Action Protocol process(es) served on the Respondents on the 19th and 23rd of February 2026 respectively and the determination of the Motion on Notice and the impending Suit.

The plaintiff also asked the court to prohibit any act of trespass, sale, lease, alienation, or interference with the land pending the determination of the motion on notice

The application, which was moved by the plaintiff’s lawyer, Akinlabi Apara, was supported by an affidavit deposed to by a litigation officer, Wale Arowosaye, and was based on an ex parte motion dated 24 February 2026. The case has been adjourned to April 17 for a compliance report.
