Delivering the judgement, the presiding judge, Justice O. Y. Anuwe, ruled that since the election that produced Prof. Damen was conducted on November 16, , 2020 he was ineligible to contest the office of national president having been holding a subsisting office of national secretary which term was supposed to end on the midnight of November 18, 2020.

The court ordered the Board of Trustees (BOT)  of the association to take over the association and swear in Dr. Uche Odionyenma immediately as national president.

The judge ruled further that the 1st and 2nd defendants were not qualified/eligible to contest the November 16, 2020 election into the office of national president of the Association of Medical Laboratory Scientists of Nigeria.
