Niger State High Court IV has refused the All Progressives Congress (APC’s) application to set aside its earlier judgement that removed Mustapha Jibrin Alheri as the party’s candidate for Chanchaga local government area in the November 10, 2022 local government polls.
The trial judge, Justice Muhammed Muhammed, affirmed that Yusuf Aminu Ladan was the authentic APC chairmanship candidate in the earlier judgement.
The court ordered the Niger State Independent Electoral Commission to present the certificate of return to Ladan as the authentic APC candidate for Chanchaga council for the election and withdrew that of Alheri.
The court ordered the state executive council to swear in Ladan as the chairman of Chanchaga LGC, however the judgment could not be enforced as Mustapha Jibrin appealed the judgement.
The APC thereafter filed a motion at the Niger State High Court IV asking the court to set aside its earlier judgement pending the hearing and determination of the appeal.
