Niger Court Vacates Earlier Order Against Army Chief

A Minna High Court has vacated the committal of contempt of court against the chief of army staff (COAS) Lt. General Farouk Yahaya and the commandant, Training and Doctrine Command, Major General Sternson Olugbenga Olabanji.

The judge of the court, Justice Halima Ibrahim Abdulmalik gave the order while responding to a motion filed before the court by the counsel to the sixth and seventh defendants, Barrister Piye Yakubu Garuba seeking the vacation of the earlier order.

She said the vocation of the order is in pursuant of order 39 rules 1 and 2  of the Niger State High Court Civil procedure rules 2018 section 36 sub section 1  of the 1999 constitution as amended.

Justice Halima added that the order is in view of the compliance with the order of the court made last year.

The defence counsel also informed the court that the witness they served to appear before the court  to give evidence in respect of the case was assigned official assignment and prayed the court for an adjournment on the matter.

Justice Halima Ibrahim after consideration of the submission, adjourned the case to the 6th February 2023 for continuation of hearing.
