A Yola High Court, presided by over by Justice Danladi Mohammed, has sacked Senator representing Adamawa Northern zone, Ishaku Abbo, from Re-contesting his seat in 2023
The court said the lawmaker was expelled by the All Progressive Congress (APC) in Mubi and is no longer entitled to seek re-election again.
Abbo approach the court challenging his expulsion by the executive committee of APC in Mubi-North LGA of the state
In the last three months, the committee expelled Abbo, accusing him of persistent condemnation of APC’s Muslim-Muslim presidential ticket.
The lawmaker prayed the court to dismiss a suit instituted by two members of the party in Mubi, and allow him to re-contest his position.
Justice Danladi held that the embattled senator and APC are bound by the resolution of Mubi North LGA Exco dated October 7, 2022, which expelled him, saying he is not entitled to enjoy any rights or privileges accorded to APC members.
The court further restrained Abbo from parading himself as candidate of the party in the Northern Senatorial District in the forthcoming general election.
Justice Danladi, declared that the court is satisfied with the procedure followed in showing the senator the way out of the party, saying that he was afforded the opportunity to defend himself but deliberately refused to do so.
He said the action of the plaintiffs in suing the senator is not an internal affair of the party as claimed, and that they have locus standi to institute the action against him since they are registered members of the party.
It could be recalled that two APC members, Abdullahi Suleiman and Yusha’u Usman of Kolere and Sabon Layi Wards, Mubi North LGA, respectively, sued the Senator and sought for an interpretation regarding his status in APC.
