Court Stops Rivers Assembly From Going Ahead With Impeachment Proceedings Against Fubara, Odu

A Rivers State High Court sitting in Oyigbo in Oyigbo local government area of the state, has issued an order of interim injunction restraining the Rivers State House of Assembly, from going ahead with the impeachment proceedings against Governor Siminalayi Fubara and his deputy, Professor Ngozi Odu.

The court also restrained the Chief Judge of the state, Justice Simeon Amadi from receiving, forwarding, considering and or however acting on any request, resolution, articles of impeachment or other document or communication from the State House of Assembly.

The order followed two separate suits filed by the deputy governor, Odu following a formal request from the House of Assembly to the Chief Judge seeking the setting up of a seven-man panel to investigate allegations of gross misconduct levelled against the duo.

Joined in the suits are all the 30 members of the House, including the Speaker, Rt. Hon. Martins Amaewhule and the Clerk of the Rivers State House of Assembly.

The presiding judge, Justice F.A Fiberesima, in a ruling in a motion exparte in the two separate suits, also granted leave to claimants/applicants to serve the interim order, the originating processes in the suits and all other subsequent processes meant for first to thirty one defendants at the gate of the Rivers State House of Assembly quarters.

The Court also directed that the interim order, the originating processes in the suits to the serve on the number thirty two dependent who is the Chief Judge of the state through any staff of Judiciary at the Chief Judge’s Chambers within the high premises.

Justice Fiberesima thereafter adjourned the case to January 23, 2026 for motion.

The Rivers State House of Assembly had earlier vowed to continue with impeachment proceedings against the governor and his deputy.

The chairman, House Committee on Information, Petitions and Complaints, Hon. Enemi Alabo-George, at a press conference in Port Harcourt, yesterday, accused Fubara and his deputy of acting as if the Rivers State House of Assembly does not exist and using several media platforms to attack the state legislature, as well as using the church to spite members of the House of Assembly.

The House spokesperson urged the people of Rivers state to read the notice of allegations against the governor and his deputy to appreciate the situation and context of lawmakers’ position better.

He alleged that previous attempts at resolving the political quagmire failed because the governor did not abide by any agreement and cannot be trusted and the only way out for the Assembly is to apply the solution prescribed by the 1999 Constitution, as altered, which is the impeachment of the “incorrigible governor and the deputy governor.”
