Demolition: Federal Housing Authority, Developer’s Case Adjourned

A Federal Capital Territory (FCT) High Court sitting in Bwari, Abuja, will on May 6, 2026, hear the case filed by Tulwu Integrated Ltd against the Federal Housing Authority (FHA) and AIBEN Properties.

The defendants were dragged to court in Suit No: FCT/HC/BW/CV/227/25 over the alleged encroachment on a property located along 5th Avenue, 52 Road, Gwarinpa Il Estate, Abuja, belonging to Tulwu Integrated Ltd.

The claimant had filed an application seeking the court order directing the parties to maintain the status quo in the matter.

Justice M. A. Madugu, on March 6, issued an order restraining the FHA and AIBEN Properties  from encroaching on the Gwarinpa property.

During the sitting, Tulwu Integrated Properties, through its counsel, Godwin Sunday Ogboji (SAN) and Abdulazeez Ibrahim (SAN), told the court that it had filed an application for amendment and to vacate the earlier order granting amendment, and that the defendants were still within time to respond.

The claimant’s counsel moved for the order directing the parties to maintain the status quo pending the determination of the suit.

 

The counsel for the second defendant (FHA), Ademola Adeleyin and Ayodeji Eoyede, adopted his counter-affidavit and written address in opposition to the application.
